Netbinc Rewards Terms and Conditions

The following Terms and Conditions (the "Rewards Terms") along with our Terms of Service (the “Netbinc Terms”, found at https://netbinc.com/legal/terms.html) govern your access to and participation in Netbinc rewards program (the “Program”). By using, browsing, and/or reading the Program via Netbinc.com (the “Website”), its associated mobile application (the “App”), and any services (collectively “Services“) operated by Netbinc Corporation ("Netbinc", "we", "our", "us"), it signifies that you have read, understood, and agree to be bound by the Rewards Terms.

In case of any conflict between these Rewards Terms and the Netbinc Terms, the Netbinc Terms will take precedence. Upon the termination of the Program or your participation in the Program, the Netbinc Terms will continue to apply to your use of Netbinc.

1. Account Eligibility

1. You must be at least 18 years old to participate in the Program.
2. Your account must represent a real person and be a unique presence of that person.
3. Accounts for entities, including but not limited to brands, businesses, listings, communities, charity organization, and general interest groups, are ineligible for the Program.
4. Your account must have been active for a minimum of 180 days, defined as logging into the App and publishing at least 1 post, like, and comment per day.
5. Fake engagement is prohibited. This includes, but is not limited to, paying for or incentivizing followers, likes, or comments that do not reflect genuine interactions.
6. You agree not to, and will not authorize or encourage any third party to use automated, deceptive, fraudulent, or invalid methods, including but not limited to using bots, automated tools, repeated manual clicks, financial incentives, or any illegal or misleading practices to artificially boost engagement.
7. You must reside in a country in which Netbinc, Paypal, and/or Stripe is available.

2. Content Standards

1. You represent and warrant that you are the original creator and sole author of the posts, photos, images, graphics, videos, Quicks, text, sounds, musical works, data, documents, files, information, works of authorship, and other content or materials (collectively, “Content").
2. You affirm that you hold all necessary rights, licenses, and permissions to the Content, and that such Content does not infringe upon any intellectual property rights or other legal rights of third parties unless proper authorization has been obtained.
3. Content that is unoriginal, including that which is reproduced without substantial and meaningful modification such as commentary, parody, and creative editing as determined by Netbinc in its sole discretion, is ineligible for the Program
4. Content that is gibberish, nonsensical, or composed of characters lacking meaning in any language is ineligible for the Program.
5. You must not post the same Content multiple times on one account or across different accounts.
6. You must not post any information that is false, misleading, or constitutes misinformation. This includes, but is not limited to, content that may deceive, mislead, or falsely inform others, or that is known to be untrue or unverifiable.
7. You warrant that you will not post or encourage anyone else to post any Content that is illegal, hateful, discriminatory, derogatory, threatening, harassing, abusive, violent, gory, invasive of privacy or publicity rights, defamatory, vulgar, obscene, profane, nude, partially nude, pornographic, sexually suggestive, or otherwise offensive as determined by Netbinc in its sole discretion.
8. Content generated by artificial intelligence, including but not limited to any content created, authored, or substantially modified by AI technologies, is ineligible for the Program.
9. Content used for any advertising, promotional activities, commercial purposes, or solicitation of any kind is ineligible for the Program.
10. Content that contains hyperlinks to external websites, social media platforms, or other digital resources, as well as shares of listings pages and deals in the App are ineligible for the Program.

3. Payment Terms

1. Payout for the Program may be made through one of the following third party providers (the “Payment Gateway Providers”): Paypal, Stripe, Western Union, or others.
2. You warrant that you have familiarized yourself with, and agree to be bound by, the applicable Terms, Cost, and Conditions of Use, Privacy Policy and other relevant legal documentation provided by the Payment Gateway Providers. We are not responsible for any failure of the Payment Gateway Providers to process the payment.
3. The email associated with your Netbinc account must correspond with the email on your PayPal or Stripe account.
4. Payout requests may be made upon reaching a total balance of $100. Payout may not exceed $150 a month, and any excess earnings will be carried forward to the next month.
5. We reserve the right, at our sole discretion, to withhold or refrain from issuing payment to you if you, your account, and or your Content do not comply with the Rewards Terms and Netbinc Terms.
6. You acknowledge and agree that you are solely responsible for any taxes, service charges, transaction fees, or other financial obligations arising from the payments you receive from Netbinc.
7. You further agree and acknowledge that Netbinc reserves the right to withhold any amounts required by applicable law to be paid to governmental authorities from such payments. Any amounts withheld in this manner shall be treated as paid to you by us.
8. You represent and warrant that all information provided in your payout application is true, accurate, and complete. You agree to keep this information up to date and accurate at all times. We may request verification of your identity, place of residence, or other relevant details as necessary for tax, legal, regulatory, or compliance purposes.
9. By submitting an application for payout, you acknowledge and accept that the review process and the subsequent payment may require a period of time. You also agree that Netbinc is not responsible for any consequences or inconveniences arising from such delays.

4. General Conditions

1. We reserve the right to amend these Rewards Terms at our sole discretion. Your continued use of the Service following such modifications constitutes your acceptance of the revised Rewards Terms.
2. We may suspend or terminate your participation in the current or any future Program if you breach these Rewards Terms or if we determine, in our sole discretion, that such action is necessary.
3. We reserve the right to establish, remove, or revise the Program obtained through the Service, and to discontinue, modify, or change the availability of the Program at any time at its sole discretion. We may make such changes at any time and for any reason, and we shall not be liable for any impact such changes may have on users or their participation in the Program.
4. The Program operates based on a limited budget, with payments allocated on a first-come, first-served basis. Once the budget is exhausted, no further payments will be made, regardless of your eligibility or the amount requested. You understand and agree that, if the budget is depleted before your payment is processed, we are under no obligation to pay out the remaining balance. In such cases, you agree not to hold us liable for any unpaid amounts, delays, or non-payments resulting from budget limitations.

5. Disclaimers of Warranties

The Program is provided on an "as is" and "as available" basis, without warranties of any kind, either express or implied. We do not warrant that the Program will be uninterrupted, error-free, or free of harmful components. There are no representations, warranties, or guarantees, express or implied, about whether you will be receiving payment or how much payment you may receive from your participation in the Program. To the fullest extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your participation in the Program. In addition, Netbinc hereby disclaims all warranties, express or implied including, but not limited to, the warranties of merchantability, fitness for a particular purpose, non-infringement, title, custom, trade, quiet enjoyment, system integration and freedom from computer virus.

By participating in the Program, you represent and warrant that your activities are lawful in every jurisdiction where you access or use the Service. You agree to indemnify and hold us harmless from any claims, lawsuits, losses, liabilities, damages, costs, and expenses, including but not limited to reasonable attorney's fees and legal costs, arising out of or in any way connected to your breach of the Rewards Terms.
